👉Judgment of the Supreme Court No:
1268/2555 A guarantee is a contract in which the guarantor
agreed to bind him/herself to creditors to pay the debt when the debtor fails
to pay the debt the guarantor does not have an obligation to treat the creditor
based on his/her certain abilities or qualifications which must be done
individually the guarantor is obligated to pay the debt to the creditor only
when the debtor fails to pay the debt which is a property obligation for this
reason, when a Mr. Por did the contract to guarantee the repayment of the first
defendant's loan, which is a complete debt under Section 681,
paragraph one, even while the death of the first defendant, the borrower has
not breached the contract yet or default the guarantor contract was not terminated due to the death of Mr. Por all
rights obligation and the various liabilities under the guarantee contract made
with the plaintiff therefore it is a legacy to the heirs under Section 1599,
paragraph one and Section 1600.✅
